Collection of Information
Types of Data We Collect. We collect personal data as well as anonymous and aggregate data. Personal data, or personal information, means any information about an individual from which that person can be identified. Personal data does not include anonymous data (data where the identity has been removed) or aggregate data that cannot reasonably be used to identify an individual. For example, if you access our Games from a shared device (such as virtual reality devices available at arcades that offer our Games to the general public) without providing your own login information, any Game Play data (see section below) collected from you is not considered personal data as such data does not directly or indirectly reveal your identity.
Information You Provide to Us. We collect information you provide directly to us. For example, we may collect information you provide to us when you inquire about licensing our games for your arcade, subscribe to our mailing list, request information, fill out a form, apply for a job, request customer support, request a STEAM® key, or otherwise communicate with us. The types of information we may collect include your name and contact information (such as your email address and phone number), and other information you choose to provide.
Information We Collect Automatically When You Use the Services. When you access or use our Services, we automatically collect information about you, including:
Game Play: When you play one of our Games we collect certain body measurements, such as height and arm length, and certain information about player movement, such as head movement. We also may collect audio metadata, such as the volume and tone of your voice (but we do not collect any actual audio files that contain your voice).
Device and Log Information: When you access our Services through a computer or mobile device, we collect information about that computer or mobile device, including the hardware model, operating system and version, unique device identifiers and mobile network information. We may also collect log information about your use of the Services, including the type of browser you use, access times, pages viewed, and the page you visited before navigating to our Services. When you play one of our Games, we may also collect the coarse geolocation data of the computer devices you use to access the game. We cannot identify your exact location or your address based on this coarse geolocation data. As of this privacy update, we no longer receive and store your IP address when you play our Games or access our Site.
Information Collected by Cookies and Other Tracking Technologies: We use various technologies on our Site to collect information, including cookies and web beacons. Cookies are small data files stored on your hard drive or in device memory that help us improve our Services and your experience, see which areas and features of our Services are popular and count visits by evaluating information such as, but not limited to, session metadata and player interactions. Web beacons are electronic images that may be used in our Services or emails and help deliver cookies, count visits and understand usage and campaign effectiveness. Information Collected From Games Accessed Through STEAM®: When you access our Games through the STEAM® platform, we may collect your public STEAM® ID, public profile, and related public display names.
Information We Collect From Other Sources
We may also obtain information from other sources and combine that with information we collect through our Services.
We do not knowingly collect personal information from children under the age of 13 (or under the age of consent established by applicable data protection law). If we learn that we are engaged in processing of personal information with such users, we will halt such processing and will take reasonable measures to promptly remove applicable information from our records. If you are a parent or guardian of a child under the age of 13 (or under the age of consent established by applicable data protection law) and believe he or she has disclosed personal information to us, please contact us immediately at email@example.com.
Our website at www.beastpets.com and our storefronts on STEAM® and Viveport® are not intended for children. These sites are intended to provide information for current and future:
Beta testers (people that consent to play testing our Games);
Customers (people that purchase or subscribe to our Games for personal use);
Business customers (companies that own or operate virtual reality arcades and entertainment centers that license our Games) and their customers that wish to find locations of arcades.
Our Games are distributed only through third party platforms (including STEAM®, Viveport®, and arcade management platforms directed at business users) where users must be over the age of 13 to create an account in order to access our Games. We do not collect personal information from users that access our Games without creating an account, e.g. users playing at a public virtual reality arcade.

How We Use Your Information
Provide, maintain and improve our Services;
Provide and deliver the information, products and services you request;
Send you technical notices, updates, security alerts and support and administrative messages;
Respond to your comments, questions and requests and provide customer service;
Communicate with you about our Games and other products, services, offers, promotions, and events offered by Beast and others, and provide news and information we think will be of interest to you;
Monitor and analyze trends, usage and activities in connection with our Services;
Detect, investigate and prevent fraudulent transactions and other illegal activities and protect the rights and property of Beast and others;
Personalize and improve the Services;
Link or combine with information we get from others to help understand your needs and provide you with better service; and
Carry out any other purpose for which the information was collected.
Our Legal Bases for Handling Your Personal Data
The laws in some jurisdictions require companies to tell you about the legal ground they rely on to use or disclose your personal data. To the extent those laws apply, our legal bases are as follows:
To honor our contractual commitments to you. For example, when you purchase, subscribe to, or license our Games (for personal or business use), we use your personal data to fulfill the contract.
To further our legitimate interests. We may handle personal data on the ground that it furthers our legitimate interests in ways that are not overridden by the interests or fundamental rights and freedoms of the affected individuals. This includes:
Providing a safe and enjoyable user experience;
Providing customer service;
Marketing, e.g. sending emails or other communications to let you know about new features;
Protecting our users, personnel, and property;
Analyzing and improving our business and products, e.g. collecting information about how you use our Services to optimize the design and placement of certain features;
Managing legal issues.
To comply with a legal or regulatory obligation. For example, keeping records of our sales for tax compliance.
Consent. Where required by law, and in some other cases, we handle personal data on the basis of your implied or express consent. Where our legal basis is consent, you have the right to withdraw consent any time. We may not be able to continue providing our Services to you if you withdraw consent.
In some circumstances, we may rely on more than one legal basis for handling personal data. For example, using personal data to improve our Games allows us to both fulfill our contractual obligations and further our legitimate interests.
Sharing of Information
With vendors, consultants and other service providers who need access to such information to carry out work on our behalf;
In response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law, regulation or legal process;
If we believe your actions are inconsistent with our user agreements or policies, or to protect the rights, property and safety of Beast or others;
In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company; and
With your consent or at your direction, including if we notify you through our Services that the information you provide will be shared in a particular manner and you provide such information.
We may also share aggregated or de-identified information, which cannot reasonably be used to identify you.
Analytics Services Provided by Others
We will only keep your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To dispose of personal data, we may anonymize it, delete it or take other appropriate steps. Data may persist in copies made for backup and business continuity purposes for additional time.
In some circumstances you can ask us to delete your data (see Your Data Rights and Choices below for more information).
In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.
We take reasonable steps to protect the information provided via the Services from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. However, no Internet or email transmission is ever fully secure or error free. Please keep this in mind when disclosing any information via the Internet.
Transfer of Information to the U.S. and Other Countries
Beast is based in the United States and the information we collect is governed by U.S. law. By accessing or using the Services or otherwise providing information to us, you consent to the processing, transfer and storage of information in and to the U.S. and other countries, where you may not have the same rights and protections as you do under local law.
Your Data Rights
If the General Data Protection Regulation (GDPR) applies to you because you are in the European Union, you have rights under data protection laws in relation to your personal data:
The right of access: to request a copy of the personal data we hold about you.
The right to rectification: to make us correct personal data about you that may be incomplete or inaccurate.
The right to erasure: in certain circumstances you can ask us to delete the personal data we have about you (unless there’s an overriding legal reason we need to keep it).
The right to restrict processing: in certain circumstances you can ask us to suspend processing of personal data.
The right to data portability: you can ask us for a copy of your personal data in a common format (for example, a spreadsheet or .csv file).
The right to object: in certain circumstances you can ask us to stop using or limit our use of your personal data (for example, if we have no lawful basis to keep using your data, or if you think your personal data is inaccurate).
Rights in relation to automated decision making and profiling: that’s a right you have for us to be transparent about any profiling we do, or any automated decision making.
If you wish to exercise any of these rights, please contact us directly. We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data. This is a security measure to ensure that your personal data is not disclosed to any person who has no right to receive it.
Cookies. Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our Services.
Promotional Communications. You may opt out of receiving informational or promotional emails from Beast by following the instructions in those emails to unsubscribe or by emailing us at firstname.lastname@example.org with your opt out request. If you opt out, we may still send you non-promotional communications.
